LEGAL NOTICE – DEALER ACCESS, DOWNLOADING AND SHARING OF COMBILIFT MANUALS

This Dealer Area (“Portal”) and all documentation made available here, including Combilift operator manuals, service manuals, parts lists, and specification sheets (collectively, “Manuals”), are the property of Combilift and/or its licensors. Access is provided solely to authorised dealers (“Authorised Users”) for legitimate business purposes relating to Combilift equipment.

1) Permitted Use

1. a) Authorised Users may view, download, and use Manuals only as required to support the sale, delivery, servicing, maintenance, and safe operation of Combilift forklift trucks.
2. b) Authorised Users may provide Manuals to verified end users who own or lawfully operate the relevant Combilift truck(s) (“Verified Owners”), and only for the purpose of operating or maintaining those trucks.

2) Restrictions on Sharing and Distribution

1. a) Except as expressly permitted in Section 1(b), Authorised Users must not disclose, distribute, publish, upload, post, resell or otherwise make Manuals available to any third party, including the general public, competitors, or non‑owner customers.
2. b) Manuals must not be uploaded to public websites, social media platforms, file‑sharing services, or any publicly accessible repository.
3. c) Copyright notices, trademarks, watermarks, document identifiers, or any other proprietary markings included in the Manuals must not be removed or altered.
4. d) Manuals must not be used to create derivative works or for any purpose unrelated to Combilift equipment.
   
   

3) Verification and Record‑Keeping

1. a) Before sharing any Manual under Section 1(b), Authorised Users must take reasonable steps to confirm that the recipient is a Verified Owner, such as checking the truck’s serial number, proof of purchase, service records, or other appropriate evidence.
2. b) Authorised Users should retain reasonable records of such verification and the Manuals shared.
   
   

4) Security and Monitoring

1. a) Use of the Portal may be monitored, logged, and audited by Combilift for compliance, support, and security purposes.
2. b) Combilift may employ technical measures (including watermarking, unique download identifiers, and access controls) to protect its intellectual property and discourage unauthorised sharing.
   
   

5) Limitations on Tracking

   Authorised Users acknowledge that once Manuals are downloaded or shared, Combilift may not be able to track all subsequent use or redistribution. This does not limit Combilift’s right to enforce these terms if any unauthorised sharing becomes known.

6) Confidentiality and Intellectual Property

1. a) Manuals contain confidential and proprietary information belonging to Combilift and/or its licensors, protected by copyright and intellectual property laws.
2. b) All rights in the Manuals remain with Combilift and/or its licensors. No rights are granted except those explicitly stated in this notice.

7) Compliance and Enforcement

1. a) Any breach of this notice may result in suspension or termination of Portal access, actions under the dealer agreement, and/or legal remedies.
2. b) Authorised Users agree to notify Combilift promptly if they become aware of any unauthorised access to or sharing of Manuals.
   
   

8) Acceptance

   By accessing the Portal, downloading Manuals, or sharing Manuals with Verified Owners, Authorised Users confirm that they have read, understood, and agree to comply with this legal notice and any applicable terms of their dealer agreement.

9) Governing Terms

   This notice supplements the terms of the dealer agreement and the Portal’s terms of use. Where there is a conflict, the dealer agreement and Portal terms take precedence.
